Excalibur Casino Faces Lawsuit Following Accidental Death

The Excalibur hotel and casino in Las Vegas is currently facing a lawsuit after the family of a guest who tragically died in an accident on the premises has claimed negligence on the part of the casino. The incident in question occurred on June 15, 2023, when 60-year-old Paul Nakashima slipped and hit his head on the side of the hotel pool while celebrating his birthday with his family. Sadly, he passed away the following day as a result of his injuries.

In response to this devastating event, Nakashima’s family has taken legal action by filing a wrongful death lawsuit against the Excalibur property. The lawsuit, which has been submitted to Clark County District Court, includes allegations of negligence, negligent infliction of emotional distress, negligent training and supervision, and wrongful death. The family claims that the pool area where the accident took place was not properly maintained to prevent accidents, citing slippery steps as a contributing factor to the danger present. Furthermore, they assert that the lifeguards who responded to the incident did not follow emergency protocols and lacked appropriate training, leading to a delay in providing necessary medical care. Additionally, the family notes that crucial medical equipment, such as an automated external defibrillator, was not readily available and had to be retrieved from other locations, resulting in a longer response time.

In addition to the physical aspects of the incident, the family also emphasizes the emotional toll it has taken on them, leading them to file for negligent infliction of emotional distress. They are seeking $15,000 in compensation, as well as coverage for legal fees and other related costs. As of now, neither Excalibur nor its parent company, MGM Resorts International, has issued a statement regarding the lawsuit.
